The Akwa Ibom state House of Assembly has declared vacant the seats of five legislators and their State constituencies.
This was made known in a press release available to Hypestation by Mr. Kufre Okon, Press Secretary to the Honourable Speaker, Rt. Hon. Onofiok Luke. The decision was taken during a plenary session on Monday and it is in line with an order ruled on Friday by the Federal High Court in Uyo and Section 109, sub section 1g of the 1999 constitution as amended.
It states: “being a person whose election to the House of Assembly was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected: Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored;”
The affected Legislators and State constituencies are; Hon. Idongesit Ituen – Itu State Constituency, Hon. Gabriel Toby – Etim Ekpo/Ika State Constituency, Hon. Victor Udofia – Ikono State Constituency, Hon. Otobong Idem – Mkpat Enin State Constituency, and Hon. Nse Ntuen – Essien Udim State Constituency
The decision follows a ruling by the Federal High Court sitting in Uyo last week in favour of the Peoples Democratic Party (PDP), ordering the AKHA to declare Idongesit Ituen’s (the plaintiff) seat vacant after he and for others had defected the PDP.
Earlier today, the State House of Assembly was attacked by hoodlums alleged to be mobilized by the All Progressives Congress in the State and the sacked Hon. Idongesit Ituen in a bid to stop the Speaker to declare seats of the Lawmakers vacant, while trying to get a ‘Stay of Execution’ from the Court.
